RESOLUTION 23 January 2015 PAVLOGRAD outgoing No.1-1 The XV-th Conference heard and discussed the Report of Dnepropetrovsk Territorial Union Organization of coal-miming industry of Ukraine on activities performed for the period 12 February 2010 through 23 January 2015. The conference noted the sufficient work on the fulfillment of decisions made by the previous ХІV-th conference for the protection of “DTEK PavlogradCoal” employees’ labor rights and social and economic interests and Union tasks. The reporting period was full of events in political, economic and social life. The XV-th Conference of PRUP notes that as a result of the acute political and economic crisis resulted in large-scale military actions in Donetsk and Lugansk regions the mining industry of Ukraine has turned out in a catastrophic condition. Due to the West Donbas mine-workers selfless labor it was produced 18 917 thousand of MT coal in 2014. Thus currently “DTEK PavlogradCoal” remains a mining stronghold in the country, supports the entire energetic complex and protects the power independence of Ukraine. On the basis of “DTEK PavlogradCoal” activities results for period 2010-2014 the West Donbas mine-workers produced 84 576 100 million MT run-of-mine-coal that is 20% of coal production in Ukraine. All mines were working stably and continuously and overfulfilled production mining tasks for the entire period. The coal mining plan was fulfilled at 103.1% and +563 900 MT above-plan mining, 125 569 running meters of mining that was 8 072 meters more for 2014. The labor mining productivity of one employee was 97.4 MT/month and increased by 23.6 MT/month compared to the same level in 2010. However the wage level of “DTEK PavlogradCoal” employees actually remains at the same level without required salary increase. 8.35% was the average wage increase in 2014 compared to 2013, and 50% compared to 2010, but remuneration of labor fund increased only in 5% in 2014. But prices for essential goods and foodstuff increased in 2 – 3 times (i.e. 200 – 300%). Operations level increased in 4 times in Ukraine. Money is not made at gas or metal, money is made at the underpaid wages and pensions. The following key tasks and problems which have been solved by the Unions for 5 years were very important: 1. Rise in the wage level. 2. Meet the production crisis occurred in 2011. 3. Make changers in the remuneration of labor fund establishment and increase in official salary. 4. Make changers in the payment system “Hay Group”. 5. Supply qualitative mining equipment (in 2011 it was lost 1 670 000 MT coal during the idle time). 6. In June 2010, the Territorial Union achieved to get bus and truck drivers returned to the “DTEK PavlogradCoal” motor company. 7. Participate in all production and economic and social issues of DTEC Company. Our work experience showed that the Union organization had an essential safety factor and gave a positive result for the stabilization and prosperity of the “DTEK PavlogradCoal” staff, was trusted by the union members and made decisions along with the company management. Steady state operations of our mines and organization departments facilitated allocation of enough funds to perform health and safety activities entirely. Our employees have all required Personnel and Collective Protective Equipment. Health protection places are equipped for the medical first aid. But our concern is associated with the level of occupational injuries and damage results at “DTEK PavlogradCoal” that remain unchanged in spite of all measures taken. It should be noticed insufficient work of safety and labor protection inspectors All Union members consolidate with the idea, discipline and responsibility. On the basis of above mentioned the XV-th report-and-election Conference RESOLVED as follows: 1. Consider the work of Territorial Union Organization “fair” for this period. 2. Approve the Report of the Union controlling and auditing committee. 3. Request from “DTEK PavlogradCoal” management to perform the following: 3.1. Timely budgetary funding of mining and ensuring of continuous operations of all “DTEK PavlogradCoal” departments in 2015. 3.2. Maintain all working places and a number of employees in 2015. 3.3. Increase official salaries and inflation rate size to all “DTEK PavlogradCoal” staff in 2015. 3.4. Perform bilateral social and economic commitments in accordance with current Collective Agreement in 2015. 3.5. Prevent occupational injuries and establish responsibility for the non-implementation of Law “On Labor Protection”, current Collective Agreement, paragraph 10.2 and III-rd plenary session of Dnepropetrovsk Territorial Union Organization of coal-miming industry of Ukraine of 17.10.2014. 3.6. Decide an issue of ecological advancement at the area of “Yubileinaya” mine ventilation shaft by means of taking measures on the garbage and debris removal from the mine area. 3.7. Audit the outsourcing company “Cleaning-Service” on the implementation of social insurance for “DTEK PavlogradCoal”. 3.8. Until 01.02.2015, repay debts on monthly deductions for cultural, physical and fitness training activities to Dnepropetrovsk Territorial Union Organization in accordance with current Collective Agreement, paragraph 14.4 as well as for health improvement of employees on the basis of direct agreements. 4. Apply to “DTEK ltd.” and “DTEK-Service ltd.” to make a Collective Agreement with the Union for 2015 with the purpose of protecting labor and social rights of “DTEK PavlogradCoal” employees. 5. Make a Collective Agreement between “DTEK-Service ltd.” management and Dnepropetrovsk Territorial Union Organization in 2015. 6. Apply to the Cabinet of Ministers of Ukraine with the following request: 6.1. Make a decision to maintain operation of the “Mining Law of Ukraine”, article 43 and Cabinet of Ministers’ decision No.887 of 12.08.2009. 6.2. Proceed with sanatorium and spa treatment funding for employees and members of their families at health resorts, holiday centers and after-work sanatoriums, improvement of the children’s health at recreation centers, child-junior sport schools in Ukraine. 7. Apply to the Cabinet of Ministers of Ukraine, regional administration, “DTEK ltd.”, “DTEK PavlogradCoal” and Central Union with the proposal to have a reservation for “DTEK PavlogradCoal” employees in the mobilization period in Ukraine. 8. Territorial and private Union organizations shall perform as follows: 8.1. Take an active part in the first stage of indefinite protest action by picketing of the Cabinet of Ministers on 28 January 2015. 8.2. Develop plan of further actions on the performance of Territorial Union Organization requirements made by the Presidium of PRUP on 26 November 2014. 9. Impose the supervision over the implementation of this decision to the members of Territorial Union Organization. Sergey I.
